Question: With the high rate of foreclosures of site built homes, and the talk of recession, shouldn’t there be more of a demand for new m/h land lease communities?   Mark C.,

Answer: Yes, with all the new homeowners being displaced from their homes, apartment vacancies are beginning to fill up fast.  We are beginning to see this in and around cities with the highest number of foreclosures.  So, in theory, the development of new m/h land lease communities should be increasing.  And, it is to some small degree, however one major obstacle remains: the availability of viable chattels home financing for homes installed on leased homesites.

 

You will recall, one of the reasons for the large number of defaults on m/h loans was the abandonment of their m/h while rushing to take advantage of low interest rates, and un-documented loan applications for new site built homes.   Many of these ex m/h homeowners and now ex site built homeowners, are back in apartments, this time with some serious credit blemishes. 

 

For them to qualify for any kind of home financing is probably going to take a long time, and a lot of credit repair and re-building.  Although they have experience with manufactured housing, they may not be good candidates for the purchase of new homes in m/h land lease communities in the near future.

 

As many of us know, right now chattel mortgage financing rates, and terms are somewhat egregious.  This is because the high rate of defaults on previous loans, caused some major defaults in payback to their investors.  Investors have demanded stricter underwriting, and lenders without any securitization, are relegated to keeping their portfolio of loans or selling to  private investor sources.  Under the circumstances, both groups are insisting on larger down payments, higher credit scores, and higher interest rates.  It is not unusual for lenders to require 10% down payments or more, credit scores of 650 or higher, limit loans to 20 year, and charge interest rates from 9.5% to 11.5% and higher.

 

Who can or wants to purchase a home under those rates and terms?

 

The current FHA Title I home financing options for m/h sited in land lease communities, which only a few years ago accounted for a substantial percentage of home loans, has been limited to $48,600 for many years, and provides very poor guarantees to the lender in the event of default.  As a result, there are only two lenders who will make these loans nationwide.  Without reforms, no more lenders are expected to participate.

 

These circumstances have all but killed the sales of m/h on leased homesites.  About the only sales left are seller financed used/repo homes which are being marketed by community owners.  Although the yield is high, it takes a lot of capital to finance these operations, and so they are limited to communities where an outside source of capital can be found.

 

One solution which is still on the horizon is the new FHA Title I reform legislation which is a part of the new Housing Stimulus Act, HR 3221.  Also referred to as the FHA Manufactured Housing Loan Modernization Act of 2008 it is currently stalled in Congress.  It provides for loans up to $69,678 with indexing for increases in the CPI, a 1 ½ % down payment,  and will guarantee the loan if defaulted on, under the same terms and conditions as they provide for the FHA Title II Programs (30 year land-home loans).  As with the other FHA home financing programs, credit approvals will not be based on pure credit scoring, but will rely on other factors for approval.  These factors often will qualify a borrower where it may have been more difficult to finance with a conventional lender who uses pure credit scoring credit approval systems.

 

Once the bill  passed and signed off by the President, it is not clear what loan amortization terms will be or what interest rates will be, other than the fact that the lenders are allowed to charge rates and terms based on the credit worthiness of the borrower. 

 

As of July 11th, 2008 the Senate disagreed to recent amendments of the House adding a new title and inserting a new section to the amendment of the Senate to H.R. 3221 by Yea-Nay Vote. 63 - 5. Record Vote Number: 173.

 

The President has said in essence:  without some significant changes in the bill which may have the effect of rewarding investors and lenders who made bad loans putting us in this predicament, he may not sign it into law.     

 

Although HB 3221 has been passed by both the House and the Senate, the bill will likely see several more changes to address current homeowners who may be facing foreclosure. There are several other proposed plans which could be meshed into the Foreclosure Prevention Act before it reaches the President for signing.

The bill may now proceed (as of July 13, 2008) to a conference committee of senators and representatives to work out differences in the versions of the bill each chamber approved. The bill then goes to the President for signing before becoming law. 

 

We will have to await the results of the conference committee to find out what changes will be made, and if they will satisfy the President, and he signs it into law.

If George Santayana was correct about reliving history, one thing is important to remember in all this, assisting borrowers in obtaining home financing for which they don’t really qualify for, just to sell a few more homes is a dumb thing for anyone to do.
